What is revenge porn?
Revenge porn is defined by the Criminal Justice and Courts Act 2015 as ‘disclosing private, sexual photographs and films with the intent to cause distress.’
To share explicit images or videos of another person without their consent, with the express intention of embarrassing and upsetting them, is a criminal offence. The law applies to both online and offline activity including material shared electronically, for example through social media accounts or text messages, or in person, by physically showing a third party the material. The offence also includes images that have been doctored.
According to the Criminal Justice and Courts Act 2015 a photograph or film is considered to be ‘private’ if it shows something that would not ordinarily be seen in public. It is considered to be ‘sexual’ if:
- It shows all or part of an individual’s exposed genitals or pubic area.
- It shows something that a reasonable person would consider to be sexual because of its nature.
- Its content, taken as a whole is such that a reasonable person would consider it to be sexual.
What are the penalties?
