What is revenge porn?

Revenge porn is defined by the Criminal Justice and Courts Act 2015 as ‘disclosing private, sexual photographs and films with the intent to cause distress.’

To share explicit images or videos of another person without their consent, with the express intention of embarrassing and upsetting them, is a criminal offence. The law applies to both online and offline activity including material shared electronically, for example through social media accounts or text messages, or in person, by physically showing a third party the material. The offence also includes images that have been doctored.

According to the Criminal Justice and Courts Act 2015 a photograph or film is considered to be ‘private’ if it shows something that would not ordinarily be seen in public. It is considered to be ‘sexual’ if:

  • It shows all or part of an individual’s exposed genitals or pubic area.
  • It shows something that a reasonable person would consider to be sexual because of its nature.
  • Its content, taken as a whole is such that a reasonable person would consider it to be sexual.

What are the penalties?

Revenge porn cases can be heard in a Magistrate’s Court or a Crown Court depending on a number of factors including the severity of the offence.

A revenge porn offence will be considered particularly serious if it is considered that the defendant’s aim was to maximise the distress caused, for example by:

  • Sending images to the victim’s family.
  • Significant planning such as setting up fake social media accounts to post the images.
  • Inviting comment and/or contact which could result in the abuse and sexualised contact from strangers.

The maximum term that can be handed down by the Crown Court for Revenge Porn is a two year custodial sentence.
