What is revenge porn?

“Revenge porn” is a commonly used term for certain offences involving the sharing or threatened sharing of intimate images without consent.

The current law is primarily contained in sections 66B to 66D of the Sexual Offences Act 2003, introduced by the Online Safety Act 2023. These provisions can make it an offence to intentionally share an intimate photograph or film without the person's consent and without a reasonable belief that they consented.

More serious forms of the offence can apply where the image is shared with the intention of causing alarm, distress or humiliation, or for the purpose of sexual gratification. It is also an offence in certain circumstances to threaten to share an intimate image.

The law applies to sharing by any means, including social media, messaging services or physically showing an image to another person.

The law has also expanded to cover AI-generated and other purported intimate images. The Data (Use and Access) Act 2025 introduced offences relating to creating or requesting purported intimate images of adults without consent, while the Crime and Policing Act 2026 introduced further offences involving tools designed to generate such images.

What are the penalties?

Revenge porn cases can be heard in a Magistrate’s Court or a Crown Court depending on a number of factors including the severity of the sexual offence.

A revenge porn offence will be considered particularly serious if it is considered that the defendant’s aim was to maximise the distress caused, for example by:

Sending images to the victim’s family.
Significant planning such as setting up fake social media accounts to post the images.
Inviting comment and/or contact which could result in the abuse and sexualised contact from strangers.

The maximum term that can be handed down by the Crown Court for Revenge Porn is a two year custodial sentence.
